Toro Negro Monthly Culinary Wine Experience Draw - Terms and Conditions

1. Promoter

The promoter is Toro Negro Winery (ABN 89 618 049 675), Gate 2 - 15 West Road, Langwarrin South, Victoria 3911 (the Promoter). Enquiries may be sent to booking@toronegro.com.au or made by telephone on +61 3 7046 9652.

2. Eligibility

1. Entry is open to Victorian residents aged 18 years or older who place an eligible order through toronegro.com.au and provide a valid billing email address and Australian telephone number.
2. Directors, officers and employees of the Promoter, contractors directly involved in conducting the promotion, and their immediate families are not eligible.
3. The Promoter may request reasonable proof of age, identity, Victorian residence and order eligibility before awarding a prize.

3. Monthly promotion periods

All dates and times are Melbourne, Victoria time (AEST or AEDT as applicable). Each row below is a separate trade promotion lottery.

4. How to enter

1. During a monthly promotion period, place an online order at toronegro.com.au containing at least $25.00 of eligible merchandise and complete payment at the normal retail price.
2. Eligible spend is the merchandise line total including GST after discounts. Delivery, cold-service charges, other service fees, gift-card purchases and refunded amounts do not count.
3. One unique entry is created automatically for each eligible paid order. There is no separate entry fee. Multiple eligible paid orders receive separate entries.
4. An entry remains provisional until payment is confirmed. Cancelled, fraudulent, charged-back or fully refunded orders are ineligible. A partially refunded order may be reviewed and moved to the tier supported by its remaining eligible spend; an order below $25.00 after refund is ineligible.

5. Prize tiers

There is one winner per monthly promotion. The prize is determined by the eligible spend tier of the winning entry. Prize values are stated in Australian dollars.

6. Draw and winner notification

1. Each draw will take place at the Promoter's address stated above on the date and time in section 3.
2. The Promoter will use a computerised random selection from all eligible entries for that month. Every eligible entry has an equal chance of selection. Entrants do not need to be present.
3. The provisional winner will be contacted in writing at the billing email address and may also be contacted by telephone within two business days. Eligibility must be verified before the prize is confirmed.
4. The winner's first initial, surname and suburb will be published at toronegro.com.au/competition-winners/ by the date in section 3 and retained there for at least 28 days.

7. Claim, redraw and delivery of prize

1. The winner must respond within 14 days of written notification. If the winner cannot be identified, does not respond after reasonable efforts, or is ineligible, a second random draw may occur at the Promoter's address at 12:00 pm on the twenty-first day after the original draw. Any redraw winner will be notified in writing within two business days.
2. The prize will be transferred or made available within 28 days after the applicable draw and eligibility confirmation.
3. The experience must be booked in advance, is subject to available dates and responsible service of alcohol requirements, and must be used within 12 months of written confirmation unless the Promoter agrees otherwise in writing.
4. The prize is not transferable or redeemable for cash. Travel, accommodation and incidental expenses are not included.
5. If the stated prize becomes unavailable for reasons beyond the Promoter's control, it may be substituted only in accordance with applicable law, including obtaining the winner's written agreement where required.

8. Personal information

The Promoter uses the entrant's order number, name, billing email, telephone number, eligible spend tier and entry record only to administer and audit the promotion, verify eligibility, contact winners, publish the limited winner information described above, distribute prizes and meet legal record-keeping requirements. Promotion data will not be used for unrelated marketing without consent. Required promotion records will be retained for at least three years after finalisation. Privacy enquiries, access and correction requests may be sent to info@toronegro.com.au.

9. General

1. The Promoter may disqualify entries involving tampering, fraud, ineligible conduct or a material breach of these terms, subject to applicable law.
2. If the promotion cannot operate as planned for reasons beyond reasonable control, the Promoter may suspend or modify it only to the extent permitted by law and without prejudicing already accrued valid entries.
3. Nothing in these terms excludes consumer guarantees, rights or remedies that cannot lawfully be excluded.
4. The Promoter will retain accurate entry, draw, financial and prize-distribution records for at least three years after the promotion is finalised.
5. Victorian law applies. A permit is not required for a Victorian trade promotion lottery, but the promotion remains subject to the Gambling Regulation Act 2003 (Vic) and applicable regulations.
